PUBLIC SERVICE COMMISSION

The Public Service Commission was established by Section 120 (1) of the Constitution of the Republic of Trinidad and Tobago. Members of the Commission are appointed by the President after consultation with the Prime Minister and the Leader of the Opposition in accordance with Section 120 (2) of the Constitution of the Republic of Trinidad and Tobago.

Public Service Commission Secretariat

The Secretariat provides administrative and support services to the Public Service Commission and is headed by the Director of Personnel Administration. The office of Senior Human Resource Adviser performs the role of Secretary to the Public Service Commission. The Commission serves all officers under its remit in the Civil, Fire and Prison Services.

To fulfill the manpower and recruitment needs of and uphold high standards of conduct in the Public, Fire and Prison Services in a fair, timely and transparent manner to support the sustainable delivery of quality public services for the effective functioning of society.

Vision

To be the premier institution for public service employment and career mobility while upholding the highest standards of conduct by officers under its remit.

Functions of the Commission / Role and Responsibilities

Section 121 of the Constitution of the Republic of Trinidad and Tobago gives the Commission the power:
“to appoint persons to hold or act in offices …, including the power to make appointments on promotion and transfer and to confirm appointments, and to remove and exercise disciplinary control over persons holding or acting in such offices and to enforce standards of conduct on such officers …”.
Section 129 of the Constitution of the Republic of Trinidad and Tobago empowers the Commission, by regulation or otherwise, with the consent of the Prime Minister, to regulate its own procedure. In this regard, by Legal Notice No. 105 of 2006, the Commission delegated some of its functions to Permanent Secretaries/Heads of Department, the Chief Fire Officer, the Commissioner of Prisons, the Chief Administrator, the Tobago House of Assembly, and other senior officials of the Public Service. The Commission retains all the functions of its constitutional mandate, which it has not specifically delegated.

Section 126 of the Constitution of the Republic of Trinidad and Tobago outlines the qualifications for and tenure of office of members of the Commission.

The core responsibilities of the Commission are:
  • To fill the manpower needs of Ministries and Departments to ensure the effective delivery of services.
  • To assure the public of public service neutrality through constitutional oversight of public service careers.
  • To protect public officers against acts of discrimination by politicians.
  • To prevent nepotism by ensuring fairness and transparency in the appointment and promotion of public officers.
  • To ensure the good conduct and efficiency of public officers through disciplinary authority.

Regulatory Framework

The Public Service Commission is guided by the regulatory framework of the Public Service Commission Regulations of the Republic of Trinidad and Tobago, the Civil Service Act and the Constitution of the Republic of Trinidad and Tobago.

Limitations of the Exercise of Powers and Functions

  • In the exercise of its discretion, the Commission must conform with existing regulations and the rules of natural justice as set out in sections 4 and 5 of the Constitution of the Republic of Trinidad and Tobago.
  • Public officers have the right of appeal to the Public Service Appeal Board in respect of decisions of the Commission on disciplinary matters (PART II of the Constitution of the Republic of Trinidad and Tobago).
  • Public officers may also apply to the High Court for judicial review of any decision of the Commission.
  • Section 128 provides that the Commission must consult with the relevant Commission before appointing any officer from another Service.
  • Section 129 provides that the Commission can only regulate its procedures with the consent of the Prime Minister.

Composition of the Commission

Section 120 (1) of the Constitution of the Republic of Trinidad and Tobago states:

There shall be a Public Service Commission for Trinidad and Tobago which shall consist of a Chairman, a Deputy Chairman and not less than two nor more than four other members.

The members of the Commission are appointed by the President, after consultation with the Prime Minister and the Leader of the Opposition.
